There Is No Reaching the Visa Stage Without a Nulla Osta

The decisive step in an Italian process undertaken for work is the prior authorisation the employer obtains in respect of the candidate; without this document, known in practice as the nulla osta, the consular visa stage does not open. It is the employer who lodges the request, and documents relating to the company itself form part of the file too. For the candidate this means handing their own documents to the employer on time and in the right form; while the wait on the employer’s side runs on, the candidate’s record and civil registry documents can lose their currency. Once the prior authorisation is granted, it is the turn of the consular visa, and after entry into Italy of the residence permit procedures before the questura. Each of the three stages calls for documents; one copy of a translation will not carry that flow.

Asseverazione: The Translation Is Sworn at the Court Registry

Italy’s form of translation approval differs in procedure from that of many other countries. A sworn translation, traduzione giurata, comes into being when the translator submits the translation together with a record of oath before a court registry or a notary; that act is called asseverazione. Approval, in other words, arises not from the translator’s own seal but from an official record. In work files the practical consequence is that the time a translation takes depends not only on the length of the text but on planning that official step. The record, the original document and the translation are also bound physically together; if that unity is broken, the document may lose its validity.

Regulated Professions Call for a Ministerial Decision

In fields such as the health professions, engineering, architecture and teaching, practising the profession in Italy depends on a recognition decision given by the ministry concerned. The comparability assessment that can be obtained through CIMEA is an informative document and does not stand in place of that decision. A recognition file calls for the diploma, a detailed curriculum, internship and practice documents, and a document showing that the profession can be practised in Türkiye, all together. Every one of these documents requires sworn translation by the same procedure. You can see the general scope of this set on our document types page.

The Commonest Difficulty: Breaking Up the Bound Set

A problem often met with in Italian files is the separating out of the three-part whole made up of the original document, the translation and the record of oath. When the candidate opens the bound set to take photocopies, or to submit papers separately to different authorities, the document can lose its formal validity and the procedure has to be gone through again. The second frequent difficulty is a curriculum that is not detailed enough in a professional recognition application: a document listing course names but showing neither the content nor the practical hours leaves no room for comparison, and the process is drawn out by a request for further information.

The Validity Window of Documents and How to Build the Timetable

In Italian files the three-stage structure can come into conflict with the period for which documents stay valid. While the prior authorisation stage runs on the employer’s side, the criminal record certificate and the civil registry extract in the candidate’s hands grow stale; by the time the visa stage is reached, these documents may have to be obtained afresh. Every document obtained again means a fresh apostille and a fresh sworn translation. In files bound for Italy the timetable should therefore be built around the lifespan of the documents: those that do not go stale (the diploma, the academic transcript, the curriculum) are prepared first, while short-lived documents are obtained as the prior authorisation nears its conclusion.

The form of approval created by the record of oath makes this planning more important still. Each new document requires a separate asseverazione, and since that procedure runs by appointment it cannot be completed on the spot. The candidate should work out in advance which document will be attached to a record on which date, and should deliver documents to the translator in one batch; sending them one by one means a new appointment every time. It is also worth the candidate keeping a copy of the translations submitted with the professional recognition file: the same curriculum translation may later be asked for by the employer or by the professional body, and having a copy to hand does away with the need to translate it again.

Storing the bound sets is part of this planning too. The whole made up of the original document, the translation and the record of oath should be kept unopened until it is handed over; rather than opening the set when photocopies are wanted, an extra set should be prepared from the outset. Once the candidate has moved to Italy, the same documents may have to be produced again at the questura stage, and at that point having fresh documents sent from Türkiye is not practical. It is a common precaution, then, to hold at least two sets of the documents that will be used often: the diploma, the criminal record certificate and the civil registry extract. Keeping a scanned copy of each set in digital form also leaves you a reference should anything be lost or be retained by an institution during a procedure. Scanning should be done without opening the set and with the pages in order; since breaking the binding can throw the validity of the document into question, it is advisable to do this carefully and as soon as the translation is received.

This page is for general information; since work permit quotas and the conditions for professional recognition can change from one period to another, confirm the current requirements from the official announcements of the Italian consulate and the ministry concerned.
