Without the nulla osta, the visa stage cannot begin

The first step in family reunification in Italy is for the party living in Italy to obtain a reunification permit from the immigration office. Until that permit has been issued, no visa application can be made to the Italian mission in Türkiye. The permit file holds the municipal document showing that the dwelling is suitable, a declaration of income, and the Turkish documents proving the family tie. Once the permit comes through, the visa is obtained, the country is entered, and the residence permit application is made within eight days. That application is sent by post, while the fingerprint appointment is completed at the Questura.

It is worth keeping in mind that the process runs through two separate institutions: the immigration office deals with the permit stage, the Questura with the residence card stage. Either may ask for the same documents in a different form, and that is why having the originals with you matters.

Verification of Turkish documents at the mission

Italy attaches particular weight to verification at the mission where family documents come from abroad. The civil registry extract showing the family tie, together with birth and marriage certificates, is submitted to the mission and examined there. That examination looks not only at the translation of a document but at whether what it says hangs together; a difference between the information in the civil register and the statements on the visa form invites further questions. The declaration of value called for in education applications is not needed here – what sits at the centre of a residence file is documents of civil status and parentage.

What holds the process up most

The point at which files stick most often in Italy is the certificate of suitability of the dwelling. It is obtained from the municipality or from the competent health unit, sets out minimum measurements according to the number of occupants, and can take weeks to come through. The second frequent problem is failure to lodge the residence permit application within the short period following entry; a delay puts the whole process back in question. The third is the form of the translation: a translation submitted in Italy is expected to be prepared in accordance with the sworn translation procedure and bound to the document, and translations in free form are not accepted.

Where translation and approval sit

The order to follow is clear: the document is obtained in Türkiye, the apostille is completed, and the text is then translated into Italian, the apostille certificate included. Italy is among the countries that recognise multilingual international copies; obtaining birth and marriage records in that form may make translation unnecessary at some stages, though it is as well to ask beforehand whether the mission accepts such a copy. For levels of approval document by document, see our document guide, and for a comparison between countries our country list.

Separation, custody and the future of the permit

A residence permit obtained through family reunification depends on the family tie continuing. Where a marriage comes to an end, whether the permit can be converted is assessed against the time spent in Italy, the person’s employment position and the presence of children. That conversion does not happen of itself; an application has to be made to the Questura before the permit expires, and the new basis for it documented. Neglecting this opens a gap in status that is hard to make good.

Translating court judgments on custody is the bulkiest part of these files. The judgment is translated in full, with its reasoning and the endorsement of finality; carrying across the operative part alone counts as incomplete. For a judgment given in Türkiye to take effect in Italy, recognition proceedings may be needed, and those proceedings call for the apostilled original of the document.

Where children are concerned, a separate point of detail is the registration of a child born in Italy. The birth is notified to the municipality and the child is entered in the local register; the same birth then has to be notified to the Turkish civil register. This second step calls for the Italian birth certificate to be translated into Turkish – the direction of the translation, in other words, is reversed.

School enrolment likewise calls for an Italian translation of the birth certificate and of previous school papers. This requirement runs independently of the immigration file and follows the school’s enrolment calendar; documents that are not ready at the start of term can cost a year.

After the residence card

Once the residence card has been issued, residence is registered with the municipality and registration with the health system is opened. During that registration the address is verified on site. Moving on to long-term residence calls for a language test; this stage arises not in the first year of the application but several years later, though it should be kept in view when planning.

The spelling of forenames and surnames is a frequent source of trouble in Italian records. If the way Turkish letters have been carried into the municipal register does not agree with the passport, a correction request has to be opened afterwards. Keeping the name in the translation as it stands in the source, and giving the passport spelling in brackets, reduces that risk.
