What this application usually calls for
The final list varies with the institution’s own announcement; the set below is a starting point.
Italy is one of Türkiye’s busiest trading partners, and its paperwork culture has taken shape to match that traffic. This page deals with the documents a company established in Türkiye will put before an Italian chamber of commerce, a buyer, a bank or a tendering authority. An Italian company opening a branch in Türkiye is a different process, in which the same documents are translated in the opposite direction.
A system built around the chambers of commerce
Companies in Italy are entered in the business register kept within the chambers of commerce, and the extract taken from that register is the basic identity document of commercial life. That the system is built around the chambers is in fact a convenience for Turkish companies, since trade registry directorates in Türkiye also operate within the chambers. The set to send your Italian counterpart is this: a currently dated certificate of activity from the trade registry directorate, the notice in the Turkish Trade Registry Gazette, the articles of association and the signature circular. Adding a document showing your own chamber membership speeds the file along, because it answers the other side’s own reflex.
Asseverazione: the swearing procedure carried out at court
What is peculiar to Italy is the way a translation is made official. A sworn translation comes into being when the translator hands the translation in at a court registry or before a notary, swearing to it in a formal record; translation, record and original document are then bound together as a single file. This requirement of physical integrity is strictly applied. In a translation produced in Türkiye the chain is different: the sworn translator’s signature, notarisation, the apostille. Commercial counterparts generally accept that; in court, registration and public procedures, however, a swearing procedure carried out within Italy may be required. You can follow which level each document calls for on our document types page.
| File | Core documents | Level of approval |
|---|---|---|
| Subsidiary / branch | Articles of association, registry record, board resolution | The highest: notary + apostille |
| Distributorship | Certificate of activity, signature circular | A stamped translation is usually enough |
| Public tender | Currently dated registry record, financial standing documents | As the specification says; strict |
| Shipment | Invoice, certificate of origin, A.TR | The chamber and customs route |
The electronic invoicing culture and customs paperwork
Italy took up electronic invoicing early and widely; your invoice reaches the recipient’s system in a set data format, and what is expected there is not translation but the right fields matching up. The invoice is therefore not part of the translation file. The same holds for certificates of origin and movement certificates: the chambers issue them, the customs administration endorses them, and their forms are printed in more than one language. What reaches the translator’s desk is texts that create an obligation between the parties or prove an authority. In files put together without drawing that distinction, the most needless item is usually a sworn translation of the customs paperwork.
How it is delivered: digital signature and registered electronic mail
Registered electronic mail and the digital signature are well established in Italian corporate communication, and many applications run on a signed electronic file rather than on physical paper. For translation this has two consequences. The first is that the legibility of the scanned copy decides the matter; scans in which the seal and the signature cannot be made out come back. The second is that even where delivery is electronic, the original document and the translation must be seen to form a bound set: page numbers, the translator’s declaration and the seal are expected on every page. Some procedures ask for the wet-signed set to be sent by post alongside the electronic file, so see at the outset which of these two channels the specification treats as the primary one.
The power of attorney and proof of authority to represent
If a registration, a tender or a court matter in Italy is to be handled for you by your local representative, you have to prove the authority of the grantor alongside the power of attorney; a power of attorney on its own is often not treated as enough. A currently dated registry record and the signature circular supply that proof. The order never varies: signature before a notary first, then the apostille, and the translation last of all. Italy is a party to the Hague Apostille Convention; verify the current list of parties through the HCCH. Drafting the power of attorney narrowly both makes it easier for the other side to accept and reduces the risk of the authority being exceeded.
The commonest ground of refusal, and the form of delivery
At the head of the grounds of refusal in commercial files bound for Italy is the translation having been detached from the document; Italian practice is used to seeing the translation, the formal record and the original as one bound set, and loose pages are not accepted. Second comes the date of the registry record: specifications ask for a currently dated copy. Third is an incomplete set – sending the certificate of activity and forgetting the gazette notice is a common omission. Read the form of delivery from the specification, and keep the stamped, wet-signed set to hand. You can send us your file through the quotation form, and see what difference the scope makes on the pricing page.
This page is meant as a guide; countries’ approval regimes and the document formats they require may be updated over time. Where you are in doubt, it is as well to put the question to the institution before you apply.
