Apostille or consular legalisation?

Türkiye has been a party to the Hague Apostille Convention since 1985. Where the other country is a party as well, an apostille on the document is enough; where it is not, consular legalisation is required.

Azerbaijan is a party to the Hague Convention — an apostille on your documents is enough.

The order matters
  • 01 Obtain the document from the issuing authority The civil registry office, the university, the courthouse — the source document must be an original.
  • 02 Have the apostille or legalisation added The governor's office for administrative documents, the judicial justice commission for judicial ones. This step comes BEFORE the translation.
  • 03 Have the sworn translation made Prepared in line with the notarial tərcümə regime that applies for Azerbaijan.
  • 04 Notarisation, where required If the institution asks for it, the translator's signature is certified by a notary.

The “they understand the language anyway” mistake

The commonest error in Azerbaijan files is to conclude, from how close the two languages are, that translation is unnecessary. What settles the matter in an official procedure, though, is not whether a text can be understood but whether the document has been presented in the official language of the receiving institution. A document drawn up in Turkish may well be readable, yet it does not enter the file without an official translation.

Closeness brings a trap of its own, besides. Certain legal and administrative terms that look identical in the two languages differ in scope; a word-for-word carry-over can quietly change what a document means. In contracts and court judgments that risk produces concrete consequences. Where an inexperienced rendering assumes “the same word”, these two document types are where the trouble usually surfaces.

There is also a point about the alphabet: Azerbaijan uses the Latin script, but its stock of letters is not identical to the Turkish one. If that difference is not observed in the spelling of personal names and place names, records fail to match up.

Trade and contracting files

Given how many Turkish companies are active in Azerbaijan, commercial document translation is requested as often here as private files are. Tender files, contracting agreements, records of work experience and financial statements form the core of this category. What is tested in these documents is less the quality of the translation than the completeness of the set and the currency of the dates: if a document in a tender file has passed its date, the file is eliminated however good the translation may be.

Records of work experience call for particular care. The name of each project, its value, its duration and the role the company undertook must all come across plainly; a vague description of the work can lead to the experience not being accepted. In financial statements, consistent use of the line-item names is what makes statements from different years comparable.

The question of scope in a power of attorney applies here as well: if the transaction to be carried out is not named, your representative cannot carry it out. Having your local counterpart read the text of the power of attorney before you have it drawn up is the cheapest precaution there is.

Education and professional recognition

Where the purpose of the move is study, translation of the diploma and academic transcript is only the start; what really decides matters is a separate application for recognition of the diploma. That application runs to a timetable of its own, and course descriptions may be asked for. Educational cooperation between the two countries is close, but recognition does not follow automatically; holding a letter of admission does not amount to recognition.

In regulated professions such as healthcare and teaching, academic recognition is followed by a stage of professional authorisation. Records of experience and registration records come into play at that stage.

Summary by purpose

PurposeDocumentsCritical point
EducationDiploma, academic transcript, course descriptionsThe recognition application is a separate and compulsory step
WorkContract, diploma, records of experienceThe job title must be consistent across the documents
ResidenceAccommodation, income and health documentsShort-lived documents should be left to last
FamilyMarriage and birth certificatesNames must be spelled with the difference in alphabet in mind
TradeTender file, contract, financial statement, power of attorneyCurrency of dates and consistency of terms decide the outcome
This is the general framework; the definitive list should be obtained from the institution handling the matter.

The process and where to begin

Obtain the original, complete the certification chain, have the translation made, and add notarisation where it is required. Traffic between the two countries is heavy, so the process moves fairly predictably; even so, the loss when the order is broken is the same as anywhere else. In commercial files the tender timetable governs everything, which makes the day you learn the date the right day to start the translation.

Upload your documents and let us settle the scope and the delivery date together; do look at our starting rates per page as well.

Property and inheritance files

Family and property ties between the two countries are strong, so property and inheritance matters make up a substantial share of Azerbaijan files. Translation in these matters is not a formality but the load-bearing link in the chain: documents showing entitlement to inherit, title deed records and court judgments all refer to one another, and if a name or a definition used in one appears differently in another, the chain breaks.

Another point to watch in inheritance files is the documenting of family relationships. Civil registry extracts, marriage certificates, birth certificates – all of them must show the same people in the same way. If a name is spelled differently in older records, a document explaining that difference has to be added to the set as well. A translation cannot conceal the difference, but documenting it keeps the matter moving.

In the buying and selling of property, once again, the power of attorney sits at the centre. The description of the property, the block and parcel details and the name of the transaction to be carried out must all be written out plainly. A power of attorney drawn up in general terms may be refused at the land registry stage, and the process then halts until a fresh one is drawn up.

With files of this kind it is far more reliable to review the documents as a whole rather than one at a time, because the problem generally lies not in any single document but in the mismatch between them.

The information here is general in nature; the acceptance requirements and certification chain of the destination country can change from time to time. Verify the detail with the institution the papers will be submitted to.
