The partner visa runs in two stages

In Australia, spouse and partner applications do not reach permanent residence in a single step. A temporary stage is granted first; after a set period the relationship is assessed again to confirm that it is still continuing, and only then does permanent status follow. This two-stage structure does not allow you to gather your documents once and forget them, because the second stage calls for fresh evidence that the relationship has lasted. The application is handled by the ministry responsible for home affairs, and the file is uploaded through an online system. The partner living in Australia makes a separate application as sponsor, and their sponsorship history is examined.

The type of relationship also shapes the route: marriage, engagement and de facto partnership are separate categories. In a de facto partnership the expectation is that the couple have lived together for a certain period or have formally registered the relationship; for couples with no marriage certificate, that is a critical detail.

A translation without a NAATI stamp is not accepted

The strictest rule that sets Australia apart from every other country concerns translation. A translation produced inside Australia is expected to be made by a NAATI-certified translator and to bear that translator’s stamp. For translations made abroad, the translator’s full name, contact details and qualifications must appear clearly in the translation itself. Where that information is missing, the translation is refused even if its content is accurate. Files sent from Türkiye often skip this detail, and the document then has to be translated all over again.

The most common sticking point

The negative outcome met with most often in partner applications is that the relationship is weak in one or two of the four main areas of evidence. Australia assesses those four headings separately, and photographs and messages on their own are not regarded as sufficient. The second frequent problem is that the medical examination and the criminal record certificate expire; because processing takes a long time, these documents may have to be renewed. The third is that the sponsor falls foul of a waiting rule because of a sponsorship made in the past.

Where translation and certification fit in

For civil registry documents sent from Türkiye the order runs as follows: obtain the document, have it apostilled if required, and translate it last. An apostille is not always sought in migration applications; what is really expected is that the document comes from an official source and that the translation is presented in line with the rules. Colour scans of the documents are uploaded online, and the originals may be requested later. You will find the detail document by document in our document guide, and how this differs from countries with no accreditation requirement in our country guide.

Acceptance of a marriage solemnised overseas

A marriage solemnised in Türkiye is generally accepted as valid in Australia, and no separate recognition procedure is needed. What decides the matter is what the marriage certificate tells the officer reading it: the date and place of the marriage, the identity details of the parties and the authority that issued the document must all be clearly legible. The whole document is therefore translated, stamps and annotations included. A partial translation weakens the relationship evidence section of the file from the outset.

For unmarried couples, formal registration of the relationship makes matters easier. Registering a relationship at state level in Australia helps to meet the expectation about the length of time spent living together. Because no such form of registration exists in Türkiye, a period spent together in Türkiye can be shown only through secondary evidence: shared address records, tenancy agreements, bank movements and travel records are submitted together.

Some of that secondary evidence is in Turkish and needs translating. For documents such as a tenancy agreement, a certificate of residence and bank statements, a full translation is expected; a summary, or a translation of selected pages, is not accepted. As these are not official civil registry papers, no apostille is sought, but the rule about the translator’s details appearing in the translation holds here too.

Registering children born in Australia with the Turkish civil registry is a separate procedure, and at that step the Australian document has to be translated into Turkish. When the notification is delayed, the child’s Turkish identity card and passport formalities are held up as well; and because of the distance, anything dealt with afterwards takes longer still.

Family members and children

Where children are added to the file, a birth certificate, a custody order and the other parent’s consent are required. A court judgment showing that custody rests with one parent must be translated in full; translating only the operative part of the judgment is not accepted. The child’s education and health records may also count among the documents that support the relationship as a whole.

Finally, the second-stage application should not be forgotten. Once temporary status has been granted, documents are submitted for the permanent stage on a set date; keeping the evidence of shared life gathered up to that date in good order makes the work easier. If new documents are needed from Türkiye, translation time has to be planned in as well. For costs by page, take a look at our pricing page, and you can upload your documents to request a quote.
