How the labour market test reaches the documents

In Lithuanian work permit matters the employer may first have to open the post to the local labour market and show that no suitable candidate could be found. That step has no direct bearing on the candidate’s own documents, but it stretches the timetable and brings an indirect consequence with it: criminal record, civil registry and medical documents obtained earlier can lose their currency while the wait runs on. For some occupational groups the step may not be looked for at all. The sound approach for a candidate is to establish with the employer which track the matter will follow and to arrange the order in which documents are obtained accordingly, leaving the easily renewed ones until last.

Where responsibility falls under a notarised translation regime

An official translation in Lithuania acquires validity through the translator’s declaration and the notary’s certification of the signature. The notary does not examine the content, which is why a mistaken term in a translation is not cured by the certification. What causes most trouble in work files is occupational names and job titles: where the Lithuanian rendering of a Turkish title is not given in a form that answers to a heading in the country’s occupational classification, the assessor cannot determine what the post actually involves. You can see the documents falling within this scope on our document types page.

When an SKVC assessment is needed

What a foreign diploma corresponds to within the Lithuanian system is assessed by SKVC. That assessment is not compulsory in every work application; it comes into play where the post carries an educational requirement, or where the profession is a regulated one. In regulated professions the relevant authority also conducts a review of its own and asks for the curriculum and for evidence of practice. Rather than having every document translated in the fullest detail to no purpose, working out first which track will apply is the more efficient course in time and in cost alike.

The ground of refusal met with most often

The adverse outcome seen most often in Lithuanian files is that the candidate’s documents cannot be matched to the qualification the post calls for, and the difficulty grows sharpest when the translation of the job title is left ambiguous. Second comes the need to obtain documents afresh because they have aged during the wait. Third, a translation submitted without notarisation renders the document inadmissible. All three can be headed off by planning at the preparation stage.

Family members’ documents and a shared timetable

Where a candidate going to Lithuania for work moves with the family, a second set of documents comes into play: the marriage certificate, the children’s birth certificates and the civil registry extract. These too must carry the apostille and be submitted with a notarised translation. Family applications are in most cases taken up once the employee’s permit has been concluded; marriage and birth certificates, being permanent in nature, can nonetheless be prepared from the outset. The civil registry extract, by contrast, is subject to a recency requirement and should be obtained at the final stage. Where that line is not drawn, part of what was prepared for the family lapses before it is ever used.

The accommodation condition carries added weight in files that include the family: documents showing that the place of residence suits the size of the household may be asked for, and these may need translating too. The spouse’s right to work, moreover, is governed by rules distinct from those covering the employee’s permit; if the spouse intends to work, their qualification documents have to be prepared as well. Gathering all this paperwork into a single translation package means the notarisation step is carried out once, and that cuts the cost and the burden of appointments alike.

One document regularly overlooked in a family file is the paperwork on the children’s education. At enrolment the school asks for the record of study from the previous school, the report card or a statement of marks, and expects these to have been translated into Lithuanian. The immigration file and the school enrolment file run separately, but obtaining these documents and having them apostilled before leaving Türkiye is a great convenience; having school papers sent out from abroad is slow and troublesome in equal measure. The same reasoning holds for health records: the vaccination card, and any reports on chronic conditions, may be called for during enrolment. Bringing all of it into a single round of translation and notarisation cuts the cost and the burden of appointments, and appreciably quickens the family’s settling in.

The backbone of planning in a Lithuanian file is learning at the outset which track the employer will take. If the post has to be opened to the local market, the timetable lengthens and short-lived documents should be left until last; if it does not, the process is appreciably shorter and documents can be prepared earlier. This page is for general information; since work permit and residence conditions can change, confirm the current requirements from the official announcements of Migracijos departamentas and SKVC.
