What this application usually calls for
The final list varies with the institution’s own announcement; the set below is a starting point.
The foreigners’ police and the rule on how recent a document must be
Residence matters in Slovakia are dealt with by the foreigners’ police. An application for family reunification is made either at the mission or at the police unit inside the country, and once it is approved a residence card is issued. What calls for care in the Slovak system is how strictly the rule on the validity of documents is applied: civil registry and criminal record documents are expected not to be older than a set period at the moment of application. Obtaining documents early and then leaving them to sit is, for that reason, a common mistake in Slovak files.
A medical report is also required to be submitted within a short time of the residence card being issued. Where this step is forgotten the permit may be cancelled, so the timetable has to be built into the plan for arriving in the country. In Slovak files, then, managing the calendar counts for as much as preparing the papers: when a document is obtained matters as much as which document is obtained.
What each document does in the file
The marriage record shows the legal basis of the family tie, the birth certificate shows parentage, and the civil registry extract shows the family relationships as a whole. The right to occupy the accommodation is proved by a separate document: a tenancy agreement or the landlord’s consent is asked for. Whether the income is sufficient is assessed against the number of people in the household. The criminal record certificate is needed for the public policy examination and is expected not to be older than a set period. An official translation is required for every one of these documents where it comes from Türkiye.
| Document | Point to watch |
|---|---|
| Civil registry extract | Must be recently dated |
| Criminal record | Must not be older than a set period |
| Housing document | The right to occupy shown clearly |
| Medical report | Submitted shortly after arrival |
The problem that comes up most often
The commonest reason for an application in Slovakia being sent back is that the dates on the documents have fallen outside the rule. When the wait for an appointment stretches out, a document that was valid when the application was made may count as out of date by the time the decision is taken and its renewal is required, which means the translation has to be renewed as well. The second frequent problem is that the translation was not made by a translator entered in the Ministry of Justice register. The third is failure to hand in the medical report, due after arrival, within the time allowed. Taken together, the three show that the Slovak process is one built around the calendar.
Translation and attestation
The order runs like this: the document is obtained, the apostille is completed in Türkiye, and the official translation into Slovak is made after that. In Slovakia the authority to produce an official translation rests with translators entered in the Ministry of Justice register, and the translation is bound to the document and sealed. Whether a translation made in Türkiye is accepted varies with the procedure; in critical files a locally registered translator may be required. Detail document by document is set out in our document guide, and a comparison with the practice of neighbouring Czechia can be found in our country list.
Children, separation and civil registration
Where children are brought to Slovakia the birth certificate shows parentage, but the examination concentrates on custody. A parent coming alone is asked for the other parent’s consent, or for the court judgment settling custody; the judgment is submitted in full, together with the finality endorsement, in official translation. It is worth remembering that these papers are subject to the validity rule too: a judgment obtained early may have to be renewed along with the record certificates.
A permit resting on a family tie depends on that tie continuing. If the marriage comes to an end, whether the permit is kept is assessed against the time spent in the country, the person’s employment position and whether there are children. That assessment is not made of its own accord: the foreigners’ police have to be approached before the permit expires and the new basis has to be documented.
School enrolment is a chain of its own. To decide which class the child will be placed in, the school management asks for earlier education documents and the birth certificate, and a Slovak translation is expected at this stage as well. Since enrolment periods open on set dates, the papers need to be ready early.
Reporting children born in Slovakia, and a marriage celebrated there, to the civil registry in Türkiye is a separate obligation. At this step the Slovak document has to be translated into Turkish; the direction of translation reverses, and where the report is late the child’s Turkish identity papers are held up too. Until the report is made the person continues to appear in the records in Türkiye with their former marital status, which throws up unexpected obstacles in title deed, inheritance and power of attorney matters.
Marrying in Slovakia, and what follows
A Turkish citizen marrying in Slovakia is asked for a birth certificate, a civil status certificate and a certificate confirming that there is no impediment to marriage; the documents are submitted in official translation. After the ceremony the marriage is entered in the local register. For a marriage celebrated in Türkiye to be recognised, the apostilled original of the marriage certificate and its translation are likewise needed.
At card renewal, and at the move to permanent residence, it is shown once more that the family tie continues and the conditions have been kept up. Fresh documents from Türkiye are commonly called for at these stages; planning the time to obtain them together with the time to translate them keeps delay away. What is described here rests on common practice; a country’s legislation and the way its institutions work may be updated. It is as well to check the current requirements against an official source.
