English being an official language shortens the process

Malta’s greatest practical advantage in residence and family applications is that English is an official language. For documents going from Türkiye an English translation is accepted directly, and no Maltese translation is asked for on top of it. Set beside other countries of comparable size, that noticeably simplifies the preparation of documents. Residence and identity matters are dealt with by Identità; applications run on an appointment system and the original documents are produced at the appointment. In family reunification it is the type of residence held by the party lawfully present in Malta that determines whether there is a right to bring family over.

There is a difference, too, between joining a spouse who is an EU citizen and joining one who is a third-country national: the first proceeds on a lighter set of documents, while the second brings a detailed examination of income, housing and insurance.

Marrying in Malta: the notice and the register

Couples marrying in Malta apply to the civil registry, and the foreign party is asked for a birth certificate together with a document showing marital status. Where there is an earlier marriage, the divorce decree has to be submitted as well. The registry expects the documents to be recently dated. After the ceremony the marriage is entered in the Maltese register, and that entry becomes the basis of the residence application. Where the marriage was contracted in Türkiye, recognition of the entry is sought with the apostilled original of the marriage certificate and its English translation.

The setback met with most often

What applications in Malta catch on most often is not the content of the documents but the working of the process: getting an appointment and handing in a complete file. A missing document means taking a fresh appointment, and that can cost several weeks. The second frequent problem is a housing document that does not rest on a registered tenancy agreement; tenancy agreements are expected to be registered in Malta, and an unregistered one leaves the file weak. The third is health insurance whose cover does not extend to family members. Refusals arising from the translation, thanks to English, are comparatively rare.

Where translation and the apostille come in

For documents going from Türkiye the order is this: the document is obtained, the apostille is completed, and then the text, the endorsement included, is translated into English. Since there is no sworn translator system in Malta, what counts is the statement of accuracy attached to the translation and the office stamp. This is much like the practice in the UK and Ireland. You can find which statement is needed for which document in our document guide, and a comparison with countries that do have a sworn system in our country list.

What becomes of the status if the couple separate

Family-based residence depends on the relationship continuing. If the marriage comes to an end, whether the status is kept is assessed by reference to the time spent in Malta, the person’s employment and whether there are children. That assessment is not made of its own accord: an application has to be put to Identità before the card expires, documenting the new basis. Otherwise the card is not renewed and the right to remain in the country comes to an end.

In an application of that kind the full translation of the divorce decree comes to the fore. For a judgment given in Türkiye to take effect in Malta, it is expected to be submitted apostilled, with its annotation of finality, and translated in its entirety. Rendering the operative part alone is treated as incomplete, because the scope of the judgment is read from the reasoning.

Where children are concerned there is a further detail: the registration of a child born in Malta. The birth is notified to the civil registry; the same birth then has to be notified to the Turkish civil registry, and at that step the Maltese document has to be translated into Turkish. For school enrolment an English document can be used directly, so no additional translation burden arises; this is a marked convenience compared with the other Mediterranean countries. Even so, English translations of the school reports and the birth certificate brought from Türkiye are asked for; the convenience lies not in translation being unnecessary but in there being no need to carry the text into a second language. Knowing that distinction from the outset saves you preparing documents for nothing.

The identity card and the steps that follow

Once residence is approved an identity card is issued, and in daily life that card is the key to banking, health and tenancy matters. At each renewal it has to be shown again that the couple are still living together and that the income condition is still met. Malta being a small country, information moves quickly between institutions, and inconsistencies between statements are readily noticed.

Further ahead, at the long-term residence and citizenship stages, documents are called for from Türkiye once again; at that point a currently dated birth record and a criminal record certificate are needed. Keeping the spelling of names used in the first file heads off the record inconsistencies that would otherwise surface years later. To see which of your documents need translating, upload them and request a quotation, and look through the cost on our pricing page.

The information on this page gives the general framework; the authority you apply to may ask for further documents or a different form. The final requirement is set by the authority the application is made to; confirm it beforehand.
