A system that rests on policy documents

Family reunification in Ireland is administered less through a single statutory provision than through published policy documents. These set out in detail who may bring family members and on what conditions, what level of income is expected and which items of evidence will be asked for. In practice that makes reading the relevant policy text before applying all but obligatory, because the status of the party already settled in Ireland – work permit holder, student, Irish citizen or EU citizen – determines the right to bring family directly, and under some statuses that right is limited.

For nationals of countries that require a visa, the application begins with the visa stage; after entry, the person registers with the immigration unit and receives a residence card. Registration appointments are heavily booked in some periods, so the appointment has to be made immediately after arrival.

Marriage: the file opened at the registry, and the notification

Couples marrying in Ireland give advance notice to the civil registration service, and a statutory waiting period runs between the notice and the ceremony. From the foreign party the registry asks for a birth certificate, a document showing marital status and, where there has been a previous marriage, the divorce decree. The certificate of no impediment or certificate of capacity to marry obtained in Türkiye is the foundation of this file. The registry also looks at your immigration position, and in certain cases a notification is made to the immigration authority; this is a practice that sets Ireland apart from its neighbours.

What causes applicants the most difficulty

The negative outcome met with most often in Ireland arises where the status of the settled party is not one that lends itself to bringing family. Next comes the finding that income has not met the level set in the policy document over the preceding years; Ireland looks back over income history, and a history of social welfare payments is weighed against the applicant. The third is thin evidence of the relationship. Refusals traceable to the form of the documents are comparatively rare, since an English translation is accepted directly and there is no sworn translator requirement.

The form the translation takes

An official translation in Ireland is submitted with a statement of accuracy and the stamp of the agency or of the translator. The statement records that the translation corresponds to the original, together with the translator’s name and the date. The whole of the document is translated; a partial translation is not accepted. An apostille is not invariably looked for in visa files, but it may be asked for in registry and court matters. You can see which form is needed document by document in our document guide, and how this differs from countries with a sworn system in our country list.

Children, school and birth registration

Where children are brought to Ireland, the birth certificate and the custody position are examined together. A parent travelling alone is asked for the other parent’s written consent or for the court judgment governing custody. Divorce decrees are translated in full, together with the endorsement of finality; conveying only the operative part is treated as incomplete. These documents make up the bulkiest part of the file, and preparing them takes longer than it does for civil status documents.

School enrolment is a separate chain. Schools ask for previous educational documents and the birth certificate in order to decide which year the child will be placed in, and an English translation is expected at this stage too. Since enrolment periods open on set dates, it is sensible to prepare the documents alongside the immigration file.

Nor should the registration with the Turkish civil register of children born in Ireland, and of marriages solemnised there, be forgotten. That notification requires the Irish document to be translated into Turkish; the direction of translation reverses. Where the notification is late, the child’s Turkish identity card and passport procedures are held up as well.

Visits are another subject that comes up often. For a short visit by parents or siblings from Türkiye, a letter of invitation and statements of accommodation and financial support are required; these documents are drawn up in Ireland, but translations of the invited person’s income and ties documents from Türkiye may still be needed. Papers showing the visitor’s ties, and so that they will return to their own country, are rendered into English in the same way.

The registration card and later renewals

The registration card issued after arrival in Ireland is the basic document evidencing residence status, and it must be renewed before it expires. At renewal you show again that the relationship subsists and that the income condition is still met. Letting the card run out creates a gap in status that is hard to repair afterwards.

In the longer term, when a citizenship application comes into view, fresh documents are asked for from Türkiye: an up-to-date record of birth and, where needed, of marriage. The copies used in the first file cannot serve. A consistent spelling of names and a consistent choice of terms from the outset make for coherence in translations produced years later. To upload the documents you hold and see which of them need translating, you can request a quotation, and you can review the per-page cost on our pricing page.

The account below summarises typical practice; each consulate applies its own current guidance. For the conditions in force, consult the institution’s up-to-date list of documents.
