Power of Attorney Translation and the Chain of Certification
A power of attorney is a document by which one person authorises another to carry out particular transactions on their behalf, and it is among the most frequently used instruments in cross-border matters. When someone living abroad deals with a property, inheritance or company matter in Türkiye, and equally when someone in Türkiye acts abroad, a power of attorney is usually what makes it possible. This guide sets out the translation and certification side of such documents, together with the chain that changes according to the direction of travel.

Two things decide the fate of a power of attorney: how clearly the document defines the authority it grants, and whether the chain of certification has been built correctly. A gap in the wording of that authority can lead the body handling the transaction to refuse it on the ground that “there is no authority for this transaction”, which is why an exact rendering of the scope of authority is critical in translation. A power of attorney is also among the most expensive documents to put right once something has gone wrong, because in most cases it has to be drawn up again.
A power of attorney puts trust on a legal footing, and so every sentence in it draws a boundary around the authority being given. A well-drafted one is clear enough to allow the transaction to go through, yet measured enough not to hand over authority that is not needed. Translation neither narrows this balance nor widens it; it carries it across exactly as it stands. The genuinely critical decision in the process is therefore taken while the document is being drawn up, and the translation is a faithful mirror of that decision.
Direction decides everything: outbound or inbound?
Will the power of attorney be drawn up in Türkiye and used abroad, or drawn up abroad and used in Türkiye? The chain runs differently in each case. Where the direction is misunderstood, every step of certification is taken in the wrong order and the document becomes unusable. The table below compares the two directions.
| Direction | Drawn up by | Typical chain |
|---|---|---|
| From Türkiye to abroad | Turkish notary public | Notarisation → translation → apostille (judicial authority) |
| From abroad to Türkiye | Foreign authority / Turkish consulate | Certification or apostille at source → translation in Türkiye → notarisation if required |
| Drawn up at a consulate | Turkish diplomatic mission | May be valid in Türkiye directly |
A power of attorney drawn up at a consulate is a considerable practical convenience. When a person abroad has one drawn up at a Turkish diplomatic mission, the document can in most cases be used in Türkiye directly, because it has been issued by a Turkish authority. This route may remove the need for a separate chain of foreign certification and translation.
The process step by step (from Türkiye to abroad)
- Establish the transaction and the scope of authority. Whatever transaction the power of attorney is being drawn up for must appear expressly in the text.
- Have the power of attorney drawn up before a notary public. The document is prepared in the notary public’s presence, and the details of the parties and of the authority are fixed at that point.
- Have the sworn translation made. The sentences conferring authority, the names of the parties and the identity details are carried across exactly.
- Obtain the apostille from the judicial authority. A notarised document counts as a judicial document, so the endorsement is obtained from the judicial justice commission.
- Confirm the order the destination authority expects. Whether the apostille is affixed to the original or to the certified translation depends on what the destination country asks for.
Points to watch in the wording of the authority
The difficulty that arises most often with powers of attorney is an attempt to use narrowly drafted authority for a broad transaction. Where authority has been given for one transaction only and a related but separate transaction is then attempted, for instance, the body concerned may not accept it. Translation does not solve this; a translation conveys only the authority set out in the source text. Establishing the scope correctly is therefore the business of the stage before translation.
The opposite carries a risk of its own: authority wider than the matter requires can have consequences you would rather avoid in terms of security. A good power of attorney is broad enough to allow the transaction to be carried out, yet narrow enough to confer no authority beyond that. Striking this balance belongs to the drafting stage, and the translation preserves it exactly as it is.
Common mistakes
- Keeping the scope of authority too narrow. If a transaction does not appear in the text, no authority for it is deemed to exist.
- Looking for the apostille at the governor’s office. A notarised power of attorney is a judicial document, and the endorsement is obtained from the judicial justice commission.
- Writing the parties’ names differently from their identity documents. A power of attorney whose names cannot be matched will not be processed.
- Skipping certification at source on a foreign power of attorney. An authority in Türkiye will not accept a foreign document that has not been certified in its own country.
Questions that come up often
Does a power of attorney have a period of validity? The document itself is not generally limited in time, but the body handling the transaction for which it will be used may ask for one of recent date. A power of attorney can also be revoked at any time, and that is a safeguard which goes beyond any question of duration.
Can several transactions be carried out with a single power of attorney? Yes, provided that authority for each one is expressly given in the text. The same document cannot be used for a transaction the authority does not cover, which is why the scope has to be settled correctly from the outset.
Can the attorney pass part of the authority to someone else? Only if the power to delegate, that is to appoint a substitute, appears expressly in the text; otherwise the attorney cannot transfer the authority to anyone. This detail is preserved exactly in the translation as well, because it forms part of the scope.
In what form should I have the power of attorney drawn up? The form depends on notarial practice and on what the body where the document will be used expects. A power of attorney drawn up before its place of use has been settled may later be turned away on grounds of form, so the destination authority’s requirement should be asked about at the start.
The difference between general and special authority
Powers of attorney can be divided into general and special according to the scope of the authority they confer. General authority allows a wide range of transactions within a given field, whereas special authority is limited to the transactions listed one by one. Some transactions, by their very nature, expressly require special authority, and for these a general power of attorney may not be considered sufficient. Which kind of authority is needed for which transaction is determined by what the body carrying out the transaction expects.
For translation, the consequence of this distinction is as follows: the sentences conferring authority must be rendered in full, without narrowing or widening the scope found in the source. Narrowing the scope of a special authority by accident can cause the transaction to be refused, while widening it unnecessarily opens a gap in security. Every sentence conferring authority is therefore handled so that it corresponds exactly to the source text.
A further practical point is that a power of attorney can always be revoked. Even where the document has been drawn up without a time limit, the person granting it may bring the authority to an end through the proper procedure. This is a basic safeguard even in a power of attorney of wide scope, and it matters as much as any arrangement limited in time.
Checklist
- Does the transaction to be carried out appear expressly in the text of the power of attorney?
- If the transaction requires special authority, is that authority present in the text?
- Will the document travel from Türkiye to abroad, or the other way round?
- Will the apostille for the notarised document be obtained from the judicial authority?
- Do the parties’ names match their identity documents exactly?
In short, the two most critical decisions in a power of attorney are the scope of the authority and the direction of the chain of certification. Once those two are set correctly, the translation carries across not merely the text but the boundaries of the trust that has been placed.
