Title Deed Translation for France

Where a Turkish title deed is used to underpin a loan, an inheritance or a transfer of ownership in France, it meets an order in which property transactions run largely through a notary (notaire) and the records are held at the land publicity service (service de publicité foncière). This page looks only at the translation difference specific to France; for the general logic of block and parcel numbers, condominium ownership, shares and annotations, see our title deed translation page, and for the country’s overall regime our country guide.

The service de publicité foncière and the notaire

In France transfers of immovable property and the records that follow from them are kept at the land publicity service (service de publicité foncière), and transactions run largely through a notary (notaire), by means of a notarial deed (acte notarié). A Turkish title deed is submitted within this system as a foreign document evidencing ownership; the translation does not equate it with a French land record or an acte, but carries it on its own terms. Since the notaire will read the property and its owners from the translation, a clear and complete rendering of the owner, the description of the property and the encumbrances is what the transaction rests on.

The heading of the deed, the issuing land registry directorate and the volume, page and journal numbers are identifying data; they are not translated but carried across as they stand. If these numbers become confused with one another, tracing the record grows difficult and the notaire is prevented from matching the property correctly.

Because in a French property transaction the notaire will carry the description of the property, the owner and the encumbrances into the deed he or she is to draw up, the Turkish deed is read from a translation in which all of this can be seen in full. An omitted encumbrance or share ratio weakens the basis of the deed the notaire will create and holds the transaction up. The translation therefore carries what the deed says as it stands, without fitting the property into a French category; the characterisation and the question of equivalence are for the notaire.

The cadastre and how block and parcel are expressed

In Türkiye immovable property is identified by block, parcel and cadastral sheet references; in France the cadastre pins a property down by section and parcel (parcelle) numbers. Because the two systems do not map onto each other, the block and parcel numbers on a Turkish deed are not converted into a French parcelle number: they are carried across unchanged, with a short explanatory note where needed. These numbers are never turned into an address, and the surface area and the description of the property keep their source form.

With flats, the line between condominium ownership and construction easement matters; rendering a construction easement as condominium ownership makes the property look further along than it is. The land share appears on the deed as a fraction and is kept exactly, never merged with shareholding. The independent unit number, the block and the floor are also transferred without loss.

The foreign ownership context and the annotations

A deed is usually submitted in the context of security for a loan in France, an inheritance matter or a declaration of assets; in every case the annotations and declarations section (mortgage, attachment, usufruct, family residence annotation) is the most critical information, because it shows the burdens on the property. An empty section is information too, and the translation says so. Where property has passed by inheritance, the deed is filed alongside the certificate of inheritance and the civil registry extract and the process is conducted by the notaire; the share ratios in all three are expected to agree.

Where a property transaction runs on a power of attorney, the power of attorney is expected to contain express authority in respect of the property; general wording may not be treated as sufficient, and this detail is preserved in translation. An owner’s name matching the passport spelling exactly lets the notaire follow the chain of title without a break; a different spelling raises doubt as to whether the property belongs to the same person. The same consistency is observed for the other documents filed with the deed.

  • Do not convert the block and parcel numbers into a parcelle number or into an address.
  • Do not render a construction easement as condominium ownership; do not omit the share ratio.
  • Translate the annotations section in full; if it is empty, say so.

Certification: apostille and a court-listed translator

Since a title deed counts as an administrative document, the apostille is obtained where needed from the governor’s office or the district governor’s office. In France a translation submitted for official use must be produced by a sworn translator (traducteur assermenté) on the list of a court of appeal (Cour d’appel), or else the Türkiye chain is followed: sworn translator, notarisation, apostille. A recent register extract is often a stronger document than a deed of older date. France is a party to the Hague Apostille Convention; confirm the current position from the official HCCH list.
