Divorce Decree Translation for the Netherlands
Two things set the translation of a divorce decree for the Netherlands apart: the judgment can in most cases be recognised without a separate court action, and the translation itself has to be open to verification. This page deals only with what is particular to the Netherlands in the translation and recognition of the decree; for the general framework of recognition and enforcement, see our divorce decree translation page, and for the general regime in the Netherlands our country guide.

Partneralimentatie and pensioenverevening
The consequences of divorce in Dutch family law include institutions peculiar to it, such as spousal maintenance (partneralimentatie) and the equalisation of pension rights (pensioenverevening); the maintenance and matrimonial property rulings in a Turkish judgment are not equated with these Dutch concepts. The translator conveys the ruling as it stands, since merging interim, spousal and child maintenance under a single equivalent, or naming one of them after a Dutch institution, misrepresents the financial effect of the judgment. Where necessary, an explanation is added in brackets.
Custody and contact rulings are read in detail in the Netherlands; the custody arrangement in the judgment, the contact schedule and any ruling on the child’s surname are translated in full, because they bear on the child’s registration and rights. These rulings may be assessed by the municipality and, where relevant, by the IND. Where Dutch concepts do not map exactly onto their Turkish counterparts, the wording of the source text is kept and is not forced into a Dutch institution; the translation carries the ruling and its categories faithfully, not a reading of what was intended. To summarise a ruling, or to merge two different types of maintenance, leaves the financial and custodial effect of the judgment unclear when the municipality and the IND come to review it.
Which judgments are recognised of their own accord
Whether a foreign divorce can be recognised in the Netherlands without a separate action depends on certain conditions; criteria such as the judgment having been given by a competent authority and in due form, and the parties having been heard, play a part in the assessment. That assessment is a legal matter and not for the translator to make: the translator conveys the content of the judgment in full and adds no comment on whether it will be recognised. Whether the conditions are met is determined by the municipality or, where necessary, by the court.
A divorce decree is often bound up with residence and family reunification procedures as well, and the IND may ask for a translation of the judgment on an application that turns on marital status. The document may then go both to the municipality, for registration in the BRP, and to the IND, and both recipients can be expected to look for consistency in the spelling of names and in dates. Knowing from the start that the document is bound for more than one place makes it possible to prepare the right number of consistent sets in one go.
Where recognition of right is not available, the matter may be taken to the court in The Hague and a separate ruling on recognisability sought; at that stage the reasoning of the judgment is read closely. A translation that is complete and unabridged from the outset therefore remains usable if a second round becomes necessary. The annotation of finality is decisive on either route: because it shows when marital status changed, it is rendered clearly and in full.
Erkenning van rechtswege and registration with the gemeente in the BRP
Under Dutch private international law, foreign divorce judgments meeting certain conditions can in most cases be recognised of their own accord, with no separate action (erkenning van rechtswege). The judgment is then submitted for registration in the personal records database (Basisregistratie Personen, BRP) held by the municipality (gemeente). The registrar reads from the translation that the judgment has become final and who the parties are, so the spelling of names and the dates must be exactly consistent with the BRP entry.
In case of doubt: rechtbank Den Haag
If the municipality cannot be certain whether the judgment is recognised of its own accord, the matter may be taken to the court in The Hague (rechtbank Den Haag) and a ruling on recognisability requested. Because the reasoning and the operative part of the judgment are read in detail at this stage, a complete translation matters; an abridged one makes the assessment harder. The name of the court and the file number identify the document and are not equated with a Dutch court.
| Element of the judgment | In the beëdigd vertaler’s translation |
|---|---|
| Rbtv registration number | Must appear on the declaration page and be open to verification |
| Annotation of finality | Rendered clearly and in full (for recognition) |
| Name of the court | In its original form; not equated with a Dutch court |
| Names of the parties | Exactly as in the BRP entry and the passport |
Rbtv registration and the order of authentication
In the Netherlands the translator producing an official translation is expected to be entered in the Rbtv register; the registration number appears on the declaration page and the municipality can verify it. In a translation produced in Türkiye, a sworn translator signs it, a notary notarises it and an apostille is added. As a divorce decree is a judicial document, the apostille is obtained from the judicial justice commission.
- Check that the Rbtv number appears on the declaration page.
- Obtain the annotation of finality and have it translated together with the judgment.
- Confirm with the municipality whether recognition of right or a ruling from the rechtbank is required.
The Netherlands is a party to the Hague Apostille Convention; confirm the current position from the official HCCH list. You can have your file handled at our single office in Ankara Kızılay, see the cost on our pricing page and upload your document to request a quotation. This page is for general information and is not a substitute for legal advice; confirm the exact route with the gemeente concerned.
