Divorce Decree Translation for France
Two things set the translation of a divorce decree for France apart: how the judgment is to be entered in the French civil register, and who is to do the translation. This page deals only with what is particular to France in the translation and recognition of the decree; for the general framework of recognition and enforcement, see our divorce decree translation page, and for the general regime in France our country guide.

Prestation compensatoire and the line drawn against maintenance
The financial consequences of divorce in French family law include institutions peculiar to it, among them the compensatory allowance (prestation compensatoire), which is meant to make good the difference in the parties’ standard of living; the maintenance and compensation rulings in a Turkish judgment are not equated with this French concept. The translator conveys the ruling as it stands. Merging interim, spousal and child maintenance under a single equivalent, or naming any of them after a French institution, distorts the financial effect of the judgment. Where necessary, an explanation is added in brackets.
Rulings on custody and on contact with the child (autorité parentale, droit de visite) are read closely in France; the custody arrangement in the judgment, the days and hours of contact and any ruling on the child’s surname are translated in full. Because these rulings bear on the child’s registration and rights, they are not summarised. Where French concepts do not map exactly onto their Turkish counterparts, the wording of the source text is kept and is not forced into a French institution. Rendering a Turkish concept of maintenance or custody by an approximate French term can shift the scope of the ruling without anyone noticing, and terms are therefore chosen so as to preserve the effect the ruling has.
The répertoire civil and the stage that involves a lawyer
Certain rulings on civil status are tracked in France in a central register (the répertoire civil); a foreign divorce is reflected in the French records through the SCEC, following a review of opposabilité. In that review the parties to the judgment, the dates and the question of finality are read from the translation, so the details are expected to be consistent with the French marriage entry. The translation creates no ruling; it merely allows the authority to read the judgment correctly. A date or a name that has slipped can put the registration on hold.
Where enforcement is called for, as with maintenance or compensation, the process runs before the tribunal judiciaire by way of an exequatur action and is in most cases pursued through a lawyer. In that file the reasoned judgment, the service records and the annotation of finality are translated together; an incomplete set comes back at the first review. Determining at the outset which route is needed, opposabilité or exequatur, prevents the scope from widening unnecessarily.
For Turkish citizens living in France the consulate may be another point of application; even so, recognition and registration processes that create a ruling are not completed by a single consular transaction. Knowing this distinction from the start prevents an application at the wrong door. Where custody and maintenance rulings accompany the divorce, they have to be translated separately and by type, because interim, spousal and child maintenance produce different consequences and are not merged under a single equivalent.
Opposabilité and exequatur: the distinction
Treating a foreign divorce judgment as valid for civil status purposes alone (opposabilité) and making it enforceable (exequatur) are separate procedures in France. For recognition of marital status it is usually enough for the judgment to be submitted with its annotation of finality, whereas enforcing maintenance or compensation in France calls for an exequatur before the tribunal judiciaire. The route to be followed determines the set of documents to be translated; an incomplete file comes back at the first review.
The SCEC at Nantes and the mention marginale
A divorce concerning a French national is entered in the register by the Service central d’état civil (SCEC) in Nantes, the central civil status service for matters arising abroad; the change is shown by an annotation placed in the margin of the marriage entry (mention marginale). Since the translation is the basis of that registration, the names of the parties and the dates of the marriage and the divorce must match the French records exactly. A discrepancy of a single letter can put the registration on hold.
| Purpose | Route | Authentication |
|---|---|---|
| Recognition of marital status | Opposabilité + registration by the SCEC | Annotation of finality + apostille + assermenté or the Türkiye chain |
| Enforcement of maintenance or compensation | Exequatur (tribunal judiciaire) | Reasoned judgment + apostille |
The listed translator and the order of authentication
A translation submitted to an official body in France must be made by a sworn translator (traducteur assermenté) on the list of a court of appeal (Cour d’appel); in a translation produced in Türkiye, a sworn translator signs it, a notary notarises it and an apostille is added. As a divorce decree is a judicial document, the apostille is obtained from the judicial justice commission.
- Establish at the outset whether opposabilité or exequatur is required.
- Obtain the annotation of finality and have it translated together with the judgment.
- Confirm with the SCEC or the court whether the listed assermenté route or the Türkiye chain applies.
