Certificate of No Impediment (Capacity to Marry) Translation

A certificate of no impediment, known formally as a certificate of capacity to marry (evlenme ehliyeti belgesi), shows that there is no legal obstacle to a person’s marrying. Issued in Türkiye by the civil registry offices, it establishes the person’s marital status and capacity to marry. Although its everyday Turkish name, bekârlık belgesi, suggests single status, the certificate is not confined to those who have never married: it can equally show that no impediment exists for someone whose earlier marriage has legally come to an end.

Its principal use is in marriage procedures abroad. When a Turkish citizen is to marry in another country, the marriage authority there usually asks for a document showing that no impediment to marriage exists in the person’s own country. Since the certificate will come before a foreign authority, it is either translated into the target language or submitted in its multilingual form.

Translation is not always necessary. The multilingual form issued under an international convention is accepted in some countries without any further translation; many others, however, look for the document to be translated into their own language and authenticated. The first step is therefore to find out whether the country of marriage accepts the multilingual form or requires an official translation.

The multilingual form and official translation

Certain civil registry documents can be issued in a standard multilingual form under an international convention. Because that form presents the fields of the document pre-printed in several languages, it can be used in the countries that accept it without any additional translation. The certificate of capacity to marry is among the documents available in this form.

Not every country recognises it, though. Where it is not recognised, the single-language copy has to be obtained and translated into the target language by a sworn translator. In translation, the personal details, the marital status and the name of the issuing authority must all be conveyed in full. Which route applies depends entirely on the practice of the country of marriage.

Why currency matters so much here

Marital status can change, and that is why this certificate is one of the documents most often required to be recent. Foreign marriage authorities usually insist on a recently dated certificate, since one obtained months earlier may not reflect the person’s position today. An application made with an out-of-date certificate can be turned back with a request for a new one.

The certificate and its translation should therefore be prepared close to the date of the marriage procedure. The interval between translation and apostille counts as well; completing the authentication and translation steps one after another, as soon as the certificate is issued, keeps it valid at the moment it is used. If the sequence drags on, even a certificate obtained at the right time can become useless.

Matching names and personal details

A certificate of no impediment never stands alone in a marriage file; it is submitted together with the passport, the birth certificate and identity documents. The given name, surname and birth details are expected to be identical across all of them. A difference in the Latin-script spelling prompts the marriage authority to ask whether the two documents really belong to the same person.

In translation, therefore, the spelling of the name is kept in line with the passport. Where a surname has changed as a result of an earlier marriage, that too is conveyed exactly as it appears on the certificate. Consistency in personal details is the precondition for a marriage application to run smoothly.

Which authority issues the certificate?

The certificate of capacity to marry is issued by the civil registry offices within the system in which the person is registered; for those living abroad, consulates can also act as intermediaries. Which authority issued the certificate is apparent from the seal and signature on it, and that information is conveyed in full in translation. Translating the name of the issuing authority freely obscures where the document came from.

Where a certificate is obtained through a consulate, the place and date of issue matter. Someone living abroad who applies both to the local marriage authority and to their own consulate takes care that the documents agree with one another. That agreement is preserved by conveying the dates and the details of the authority consistently in translation.

Earlier marriages and surnames

This certificate is not issued only for people who have never married; someone whose earlier marriage ended in divorce or by death can also use it to show that no impediment to marriage exists. In such cases the certificate may carry an entry relating to the previous marital status, and that entry is conveyed accurately in translation. Omitting the earlier position makes the assurance the certificate gives look incomplete.

Changes of surname arising from an earlier marriage are handled just as carefully. If the surname shown on the certificate differs from the one in the passport, the reason for the difference must be readable from the document. The translation conveys, exactly as written and consistently, which form the name takes in which circumstance.

These details allow the marriage authority to understand the person’s position correctly. Once the link between past and present marital status is clearly drawn, the application proceeds without being held up by further questions and requests for documents. That clarity comes from preparing both the certificate and the translation with care.

Marriage files usually run to a fixed appointment or procedure date, so the timing of the certificate and its translation is as important as any of these details. When a current certificate, a spelling of the name that matches the passport and an accurately conveyed record of marital status come together, the application concludes without unexpected obstacles. Attending to these three things at once eliminates the most common difficulties from the start.

Common mistakes with certificates of no impediment

  • Assuming the multilingual form is valid in every country.
  • Applying with an out-of-date certificate and overlooking the currency requirement.
  • Leaving the spelling of the name different from the passport.
  • Seeking the apostille for a civil registry document at the courthouse; the competence lies with the governor’s office.
  • Letting time pass between translation and apostille until the certificate goes stale.

Let us prepare your marriage file in good time

The most practical step with this certificate is to establish at the outset whether the country of marriage expects the multilingual form or an official translation, and to prepare the document close to the date of the procedure. Once you send us the certificate we plan the right form and the necessary chain of authentication with you, and make sure the name details agree with your passport. You can see related civil registry documents in our document guide and the breadth of our work on the translation services page, and you can send your document through the quotation form.

The information here is offered as guidance; how recent the certificate must be and how many copies are wanted vary from institution to institution. Ask the competent authority to confirm before you apply.
