The final list varies with the institution’s own announcement; the set below is a starting point.

The voivodeship office owns the file

Residence permit and family reunification applications in Poland are made to the voivodeship office for the region where you live. That means there is no single central practice across the country: the same list of documents may be asked for in different degrees of detail in different voivodeships, and waiting times vary markedly by region. Fingerprints are taken when the application is lodged and a file number is issued; until the card is printed, the stamp entered in the passport confers a temporary entitlement. In preparing the file, working from the list the voivodeship you are dealing with has itself published is sounder than trusting to general information.

Marriage to a Polish citizen brings a separate type of permit into play, and the examination turns more on whether the marriage is genuine. Joining a spouse who is a third-country national brings the conditions on income, accommodation and health insurance to the fore instead.

Certificate of no impediment, or a court order

A foreign national marrying in Poland is asked for a document showing that there is no impediment to the marriage under the law of their own country. The certificate of no impediment obtained in Türkiye serves that purpose. Where the certificate cannot be obtained, an order of exemption has to be sought from a Polish court; that route is longer and involves proceedings. The registry office looks closely at how current the document is and at whether the chain of certification is complete. After the ceremony the marriage is entered in the Polish register, and that entry becomes the foundation of the residence file.

What keeps files waiting longest

The problem met most often in Poland is not refusal but delay: in busy periods a voivodeship office may spend months examining a file, and a request for further documents arrives during that time. Since only a short period is allowed for producing the document asked for, paperwork whose translation is not ready puts the file at risk. The second frequent problem is the translation not having been made by a sworn translator on the Ministry of Justice list; Poland applies that list strictly, and a translation from outside it is not accepted. The third is health insurance cover that does not extend to family members.

The order of translation and certification

The order runs like this: the document is obtained bearing a current date, the apostille is completed in Türkiye, and only then is it translated into Polish, the apostille certificate included. Poland is among the countries that recognise multilingual international copies; obtaining the birth and marriage records in that form may reduce the need for translation in registry office business. Court judgments and income documents, on the other hand, require sworn translation. For detail document by document see our document guide, and to compare countries where there is no regional variation see our list of countries.

The custody file in reunification with a child

The set of documents asked of a parent who wants to bring a child to Poland differs from the set for reunification with a spouse. The birth certificate establishes parentage; the real argument turns on custody. The court judgment settling custody after a divorce is expected to be submitted together with a document showing that the other parent consents to the child settling abroad. Where there is no consent, the file runs into an examination of the child’s best interests and the decision is delayed.

Translating court judgments is the bulkiest part of these files. The judgment is translated entire: the reasoning, the operative part and the certificate of finality are carried across together. Translating the operative part alone is treated as incomplete, because the date on which the judgment became final, and which right was given to which parent, are read out of the reasoning. The requirement that these translations be made by a translator on the sworn translator list holds good here as well.

Once the child has arrived in the country, a Polish translation of the birth certificate and of the earlier school records is asked for again at enrolment. That request is independent of the immigration file and follows the school’s own calendar; documents not ready at the start of the enrolment period can mean a year is lost.

Notifying the Turkish civil registry of children born in Poland and of marriages solemnised there is a separate obligation. At that step the Polish document has to be translated into Turkish; the direction of translation is reversed.

After the card: the identity number

Once the residence card has been issued, the identity number and address registration steps follow. That number is the basis of health insurance, banking and tax business. A sworn translation of the birth certificate may be asked for again when children are enrolled at school, so it is sensible to have the translations prepared in more than one copy.

In the longer term, at the permanent residence and citizenship stages, a language certificate and unbroken residence are looked for. At those stages documents bearing a current date are asked for from Türkiye, and agreement with the spelling of the name in the first file takes on importance. How the name was entered in the Polish records is a detail that may later call for correction.
