Temporary authorisation to stay first, entry to the country afterwards

Family reunification in Luxembourg works in a different order from most countries: a temporary authorisation to stay has to be obtained from the immigration directorate before you travel. Until that authorisation comes through, no visa application is made. The file goes by post straight to the immigration directorate, together with documents showing the situation of the family member in Luxembourg. Once approval arrives, the visa is issued by the representation in Türkiye, the applicant enters the country, and only then is the municipality notified and the residence permit card applied for. A three-stage structure of this kind means the same documents can be asked for again at every stage.

Which language is used depends on the body you apply to. French, German and Luxembourgish are official languages in the country; immigration correspondence is mainly in French, and German is accepted at some municipalities. Before settling on the language of translation, it is worth asking the unit you will be sending the file to what it prefers.

What each document does in the file

The birth certificate proves identity and descent, so it is asked for both in the reunification file and in the municipal registration. The marriage record shows the legal basis of the relationship; if you are marrying in Luxembourg, a certificate of no impediment to marriage and a record of marital status take its place. The sponsor’s income is examined to show that the household will not need public assistance, and the employment contract and payslips are assessed together. Housing of an adequate size and health insurance cover are documented separately. In a small country the housing market is tight, so getting the tenancy agreement into the file in time is often the hardest step of all.

Where files most often come unstuck

The most common cause of delay is that an incomplete file sends the process back to the beginning. Rather than holding an incomplete file, the Luxembourg immigration directorate asks for it to be completed, and because that exchange runs by post, weeks are lost. The second frequent problem is that the housing document is not ready at the time of application; renting somewhere large enough before you have arrived in the country is difficult, but the condition is not relaxed. The third is a translation not made by a sworn translator. Another shortcoming often seen is that only the first page of a multi-page document has been translated.

The order of translation and certification

The correct sequence is to obtain the document with a current date, complete the apostille formality in Türkiye and have the translation done last. Luxembourg is among the countries that recognise the multilingual international extract arrangement; obtaining birth and marriage records in that form can remove the need for translation at some steps. Translation remains compulsory, on the other hand, for income documents, court judgments and criminal record certificates. You will find which form of certification each document calls for in our document guide, and the differences between countries in our country list.

Long-term residence and the prospect of citizenship

As the years of residence in Luxembourg accumulate, long-term status and then citizenship come into view. At those stages a level of proficiency in the country’s own language and a course on living in society are looked for; Luxembourgish occupies a place of its own here, and knowing French or German may not on its own be counted as enough. Since the process is a long one, enrolling on a language course from the first year of residence is an investment not only in daily life but in the applications still to come.

These stages call for documents from Türkiye once again. The copies used in the immigration file are not treated as valid; a currently dated birth record, a civil registry extract and, where needed, a criminal record certificate are obtained afresh, apostilled and translated. The documents are expected not to contradict those in the first file; even a small discrepancy in the spelling of a name or in the place of birth will prompt a request for explanation.

Another point is the reporting to the civil registry in Türkiye of a marriage contracted, or a child born, in Luxembourg. Where that report is not made, the person continues to appear in the Turkish records with their former marital status, and this causes difficulty in matters of power of attorney and inheritance. For the report, it is the Luxembourg document that has to be translated into Turkish this time; the direction of translation is reversed.

A detail that comes with life across borders

A significant proportion of those who work in Luxembourg live in neighbouring countries. If your spouse works in Luxembourg but lives in Belgium or France, the country in which the family reunification application is made changes, and the document set takes shape according to that country’s rules. Settling this distinction at the outset saves you from losing time on a file prepared for the wrong authority.

Another practical point is how long documents remain valid. The immigration directorate asks for recently dated copies of civil status and marital status documents; where a document expires while the file is waiting and has to be renewed, the translation has to be renewed with it. To cut down on that repetition, it is more economical to obtain the documents together at a date close to when the file will be sent. This content is intended as information; a country’s practice on apostilles or consular legalisation may change. Settling the form the body wants at the outset saves rework later on.
