The division of labour between the préfecture, the consulate and the immigration office

Residence and family applications in France are not gathered under a single authority. The residence formalities of the party living in France run through the préfecture; the visa for the family member coming from abroad is issued by the French mission in Türkiye; and once the country has been reached there follows the stage of the medical examination and the integration contract at the immigration and integration office. A family reunification application, for its part, starts with an application by the party living in France, and the municipality and the préfecture carry out the housing inspection between them. In a structure as scattered as this it is ordinary for the same document to be asked for again at a later stage.

Marriage to a French citizen is a route of its own and is not subject to the family reunification procedure. What comes into play there is a residence card founded on private and family life, and the set of documents is built more around the validity of the marriage and the continuity of life together.

Recognition of a marriage celebrated abroad

If you are to marry a French citizen in Türkiye, the expectation is that before the ceremony a certificate of capacity to marry will be obtained from the French mission and that the pre-marital hearing will be held. Where that step is skipped, the marriage may well be valid in Türkiye, but having it entered in the French civil register becomes difficult and recognition drags on. After the ceremony, registration of the marriage in the French register is required; applying for residence on the strength of a marriage that has not been registered most often comes to nothing. In French files, then, the sequence begins before the marriage itself.

The ground of refusal met with most often

The point at which family reunification files are most often sent back is the housing inspection. The size of the dwelling and its sanitary conditions are inspected on site by the municipality, and if the number of rooms does not suffice for the size of the family the application fails. The second frequent ground is that the income is not counted as regular; short-term contracts and a broken employment history call for further documents. The third is the form of the documents: a translation submitted in France is expected to have been made by a translator on a court of appeal list, and a translation from outside the list may not be accepted. The requirement for a recently issued copy of a birth certificate is another detail often passed over.

Translation, the apostille and the multilingual copy

The order runs like this: the document is obtained with a current date, the apostille is completed in Türkiye, and the text is then translated into French, the apostille certificate included. France is among the countries that recognise the practice of the multilingual international copy; obtaining birth and marriage records in that form may make translation unnecessary in some formalities. For housing, income and court documents, however, sworn translation is essential. You will find the levels of approval document by document on our document page, and the comparison between countries in our country guide.

The spelling of names, and notification to Türkiye

French civil records treat the spelling of forenames and surnames with great care. How the letters peculiar to Turkish are to be carried into the records depends on the spelling in the passport agreeing exactly with the spelling on the document. Keeping the name in the translation as it stands in the source, and stating the passport spelling as well, forestalls the requests to correct the record that would otherwise be opened later. Where the surname has changed on marriage, the document showing that change must be in the file; without it, no link can be drawn between documents drawn up under two different surnames.

Notifying the Turkish register of a marriage celebrated in France and of children born there is a separate obligation. Where no notification is made, the person goes on appearing in Turkish records with their former civil status, and that throws up unexpected obstacles in title deed, inheritance and power of attorney matters. This notification calls for the French document to be translated into Turkish – in other words, the direction of the translation is reversed.

Further ahead, when an application for citizenship comes up, currently dated documents are again asked for from Türkiye, and they are expected not to contradict those in the first file. Keeping the spellings and the terms chosen for the first translation on record is what keeps new translations, made years later, consistent with them.

After arrival, and renewing the card

Once you are in France, residence card formalities run through an online appointment system, and in some regions finding an appointment can take a long time. It is therefore important to open the application record before the visa runs out. On renewal, documents showing that life together continues are asked for again; papers issued in France – joint bills, the tenancy agreement, the tax notice – come to the fore at this stage.

Where children are joining a parent, custody and consent are examined separately. Which party the divorce decree gave custody to, whether the other parent has consented to travel abroad, and the child’s birth record are read together. Because court judgments take longer to translate than civil status documents, these papers need to be prepared early.
